This agreement is between Madeleine Langan-Nicolaou, hereinafter referred to as the "Photographer", and the signers of this portrait photography agreement, hereinafter referred to as the "Client", collectively referred to as the "Parties", with the portrait session detailed below. This agreement contains the entire understanding between the Photographer and the Client as an order for intimate portraiture services

Boudoir Session: This is a boudoir session, which means the Photographer will photograph the client in lingerie and possibly the nude. Due to adjusting hair or directing the client to pose, the Photographer may have limited contact with the client. Permission will asked again on day of shoot. Sexual activity is prohibited during the session. If any type of sexual activity occurs, the Photographer has the right to end the session and forgo any future opportunities for rescheduling.

Payment:

The client hereby agrees to remunerate Phoenix Boudoir Photography the sum of £250 in exchange for boudoir photography services. Payment shall be structured as follows:

• An initial non-refundable deposit of £100 must be settled upon booking to confirm the session date

• The outstanding balance of £150 is to be paid no more than 7 days prior to the session.

• Any purchases of products or packages following the shoot should be paid within 30 days of the viewing unless a payment plan has been set up or has been discussed with the Photographer

  
  

T&Cs:

• No date is reserved until the deposit is received.

• If final payment is not received before the 7 days prior to your shoot it may result in cancellation.

• Any purchase of products/ packages will not be ordered until payment has been recieved in full. Unless a payment plan is in place

Cancellation/Rescheduling: If Phoenix Boudoir Photography cancels your session and cannot reschedule with 90 days, your deposit will be returned in full. If a “force majeure” causes the cancellation of your session (including but not limited to road closures due to weather conditions, war, and natural disasters), Phoenix Boudoir Photography may reschedule your session at a future date within 365 days or distribute a refund of the session fee at her discretion. In the case that you need to reschedule your session we would ask you to provide us with as much notice as possible. If it is more than 7 working days notice and we are unable to replace that booking; (every effort will be made) then we will keep 50% of the total deposit £125.

Anything less than a 7 days notice you will lose the full deposit paid as we will not be able to replace the booking.

All refunds following the shoot will be reviewed on a case by case basis and will be at my digression. Once purchased all products and Packages are non-refundable. Quality/ Manufacturing issues will of be looked into and if needed be replaced at no extra cost to you

The Session | Package Inclusions

This pays for 2-3.5 -hour portrait session, the Photographer's time, editing of the images, meeting with the client for image review, ordering and delivering prints when applicable. The Boudoir Photography session comes with a 8x10 mounted image, hair and makeover from a professional stylist, refreshment on day of shoot.

Photographers Responsibilities

The Photographer agrees to:

• Conduct the boudoir photography session in a professional manner, ensuring the client's comfort and satisfaction.

• Offer guidance and direction to the client to achieve desired poses and expressions.

• After the session, the Photographer will provide the Client a minimum of 40 high-quality images at the viewing which will take place within 2 weeks following the session date.

• The Client may purchase additional images or prints beyond the agreed-upon package for an additional fee. Pricing for additional purchases will be provided upon request.

• Delivery of any products/ packages ordered within 4 weeks of payment received

Liability: The Photographer accepts no liability for any loss, damage, or injury incurred during the boudoir photography session, including but not limited to damage to personal property or injury resulting from poses or activities during the shoot. The Client assumes all responsibility for their own safety and the safety of any accompanying individuals.

Wardrobe & Styling:

 The client is responsible for choices in wardrobe, makeup, and hairstyle. No re-shoots are available due to client disliking the wardrobe or styling in photos.

Force Majeure: In the event of unforeseen circumstances such as natural disasters, severe weather, or illness preventing the session from proceeding as scheduled, both parties agree to reschedule the session to a mutually agreeable date and time, without financial penalty to either party. The Photographer will make reasonable efforts to accommodate rescheduling requests.

Confidentiality/Privacy: Both parties agree to maintain the confidentiality of all personal information exchanged during the session. The Photographer will not disclose any sensitive information or share any images from the session without the explicit consent of the Client. Likewise, the Client agrees not to share any images provided by the Photographer without proper authorization.

Copyright/ Ownership: The Photographer maintains full copyright and ownership of all images produced during the session. It is illegal to copy, scan, reproduce, or post online in forums or elsewhere without the written permission of the Photographer. If purchasing a USB package, Clients will be given a written release to make personal copies of images and to post on their personal Social media pages. The client understands the images cannot be used for profit or advertising and all posting of images on the internet must be acknowledged as images by the Photographer. Any commercial use, reproduction, or distribution of the images requires explicit written permission from the Photographer and may incur additional fees.

Mandatory age of 18 or older: The client must be 18 years of age or older to participate in this boudoir session.
